Dear Co-Chairs,
I agree with Alain's assessment that the proposal, in its current form,
still leaves too much room for subjective interpretation and inconsistent
application.
One of the recurring concerns throughout this Last Call has been that
several key terms remain undefined or insufficiently bounded. Expressions
such as "key technical purposes," "sufficiently documented," and the
reliance on case-by-case discretion may appear flexible, but flexibility
without objective criteria can undermine predictability and equal
treatment. Good policy should minimise uncertainty rather than defer it to
future operational judgment.
I also share the concern that treating certain requests as a "first
allocation" introduces a pathway that could unintentionally weaken the
utilisation principles the policy is intended to uphold. Where exceptions
are necessary, they should be supported by clear, measurable requirements
and evidence, not broad categories that are open to differing
interpretations.
Importantly, several contributors have now proposed technically credible
alternatives or refinements. Whether through Alain's MDN-based approach or
other evidence-based proposals, these suggestions deserve substantive
consideration rather than being deferred to a future PDP. If there is broad
recognition that clarification may be needed later, that is itself an
indication that the current text has unresolved shortcomings.
Policy should provide clear guidance from the outset. It should reduce
ambiguity, promote consistent decision-making, and ensure that members
understand the basis on which similar cases will be treated. In my view,
those objectives have not yet been fully achieved, and Alain's comments
highlight why additional work on the proposal is warranted before adoption.
