I agree that downloading the archive was poor judgment. I think if you were to ask the gentleman in question you would find that he might think twice about doing this next time he encounters a similar situation.

I agree. However, in that case you are depriving the owner of the property access to his things. In this case, the contents of the list were copied, not taken. I’m don’t see this as a meaningful difference, but I can see how men of good conscience could disagree with me about it.

The board member seeking re-election did not download the data. He received a copy in email from the person who did download it. He did not solicit it. He did not read the email and deleted it without reviewing the contents.

I do not think there are any ethical issues with the conduct of Mr. Elkins in this matter.
