[Community-Discuss] AFRINIC Investigation Committee Report

Dear AFRINIC members and community,

The Governance Committee made the following recommendations with respect to the allegations which were investigated by Benoit Chambers on the report submitted to the Board on 4 May 2018  [https://afrinic.net/images/afrinic-govcom-report-to-board-20180505-en.pdf <https://afrinic.net/images/afrinic-govcom-report-to-board-20180505-en.pdf>]:
The Board accept the report;
the Board publish the relevant parts of the report to the community in the spirit of accountability and transparency;
and the Board considers the recommendations in the report for further action.

The Board agrees to the above recommendations.

The Board tasked the Governance Committee to provide a version of the Investigation Committee report that is conformant with data protection, confidentiality, privacy and other applicable laws.  The Governance Committee provided its version of the report on 25 May.  After considering the redacted version of the report, the Board then decided to further request the GC to contact the IC to provide the report conformant with data protection, confidentiality, privacy and other applicable laws that are suitable for publication. In accordance with a commitment made on 6 May 2018, that the Board intends to provide feedback to the community no later than 31 July 2018 on the next steps.  Here are some of the actions being considered:

Take appropriate human resources action on those who received adverse findings in the course of the investigation;
Establish a code of ethics as a way to address inappropriate behaviour within AFRINIC;
AFRINIC to put processes in place that will deal with issues of workplace harassment;
Revise AFRINIC’s  human resources procedures;
Set up a whistleblower mechanism;
Consider review of Board resolution 201411.211 regarding NDA;
The Board is considering the review of AFRINIC organisational structure;
Revise AFRINIC’s Board procedure and processes;
Make sure that all aggrieved parties are treated fairly;
The Board shall be initiating a community engagement survey which will be to better understand the concerns of the community with the aim of addressing them.
In due course, the Board will be providing to the community an update regarding the completion of each item of the action plan.

Chers membres et communauté d'AFRINIC,

Le Comité de la gouvernance a formulé les recommandations suivantes concernant les allégations qui ont fait l'objet d'une enquête de Benoît Chambers sur le rapport soumis au Conseil d’administration  le 4 mai 2018 [https://afrinic.net/images/afrinic-govcom-report-to-board-20180505-en.pdf <https://afrinic.net/images/afrinic-govcom-report-to-board-20180505-en.pdf> ]:

Le Conseil d’administration accepte le rapport;

le Conseil d’administration publie les parties pertinentes du rapport à la communauté dans un esprit de responsabilité et de transparence; et

le Conseil d’administration considère les recommandations du rapport pour d'autres actions.

Le conseil d’administration accepte les recommandations ci-dessus.

Le conseil d’administration a chargé le comité de la gouvernance de fournir une version du rapport du comité d'enquête conforme à la protection des données, à la confidentialité, à la vie privée et aux autres lois applicables. Le comité de gouvernance a fourni sa version du rapport le 25 mai. Après avoir examiné la version rédigée du rapport, le Conseil d’administration a ensuite décidé de demander au GC de communiquer avec le CI pour fournir un rapport conforme à la protection des données, à la confidentialité, à la vie privée et aux autres lois applicables. Conformément à l'engagement pris le 6 mai 2018, le Conseil d’administration a l'intention d’informer la communauté au plus tard le 31 juillet 2018 sur les prochaines étapes. Voici certaines des actions envisagées :

Prendre au niveau des ressources humaines, suite au résultat de l’enquête, les mesures appropriées à l'encontre de ceux qui font objet de conclusions défavorables.
Établir un code d'éthique pour prévenir les comportements inappropriés au sein d'AFRINIC.
Mettre en place à AFRINIC des processus qui traiteront des problèmes de harcèlement au travail.
Réviser les procédures de ressources humaines d'AFRINIC.
Mettre en place un mécanisme de dénonciation.
Envisager un réexamen de la résolution 201411.211 du Conseil d’administration concernant la NDA
Le Conseil envisage d'examiner la structure organisationnelle d'AFRINIC;
Réviser la procédure et les processus du Conseil d’administration d'AFRINIC;
S’assurer que toutes les parties lésées sont traitées équitablement
Le Conseil d’administration doit lancer une enquête sur l'engagement communautaire qui permettra de mieux comprendre les préoccupations de la communauté dans le but de les aborder.

En temps opportun, le Conseil d’administration  fournira à la communauté une mise à jour concernant l'aboutissement de chaque élément du plan d'action.
