<br>The existence of an Appeals Committee is indeed required in Section 3.5 of
the CPM, however, its existence is not the responsibility of the Co-Chairs but
of the Board which is mandated to appoint the Appeals Committee according to
that section of the
CPM.
<br>
<br>Due to significant friction within the Appeals Committee as well as within
the Co-Chairs certain members of the PWG, policy co-authors and certain Board
members, the Board, in 2023, controversially revised the terms of reference
(TORs) of the Appeals Committee (AC) to controversially side with certain
sections of the PWD and approve certain policies when I was a member of the
Appeals Committee. The result was the current Version 4 of the TORs which
appears inadequate and in bad
faith.

<br>Part of the controversy led to allegations that some AFRINIC members of
staff were controversially appointed based on the sides they took on certain
appeals being adjudicated by the AC at that time. Those were the dark days of
AFRINIC thankfully on which some light is now
shining.
<br>
<br>Since the Appeals Committee is the responsibility of the Board, I would
like to recommend the
following:
<br>
<br>1. The Board should review the terms of reference (TOR) of the Appeals
Committee (AC) as it appears that the current Ver 4 Terms of Reference appeal
inadequate. For example, these TORs refer to Section 3.5(2) while there is no
Part (2) in the current Section 3.5 of the CPM as shown at
https://afrinic.net/assets/pdf/appeals/afrinic-policy-development-appeal-committee-v2-20171126.pdf

<br>2. In the TOR review, the Board needs to specify where the AC reports
which it seems is missing in the current Version 4 of the TORs as at
https://afrinic.net/appeal-committee.html
<br>
<br>3. The Board needs to ensure in its appointment and/or in the TORs that
those it appoints to the Appeals Committee are of good enough integrity.
Attempts were made in previous versions of the TORs to this
effect.
<br>
<br>4. The Board may want to review Version 2 of the AP TORs where the PWD
tried harder to cover many of these issues in the TORs of the
AC.
<br>
<br>That is my humble

We appear to be operating without an Appeal Committee, which is a key component
of the PDP's conflict-resolution mechanism.

disagreements that cannot be resolved between the Chairs and the participant.

Could the co-chairs clarify whether an Appeal Committee is currently
constituted, and if not, how conflict resolution is expected to function under
