Bonjour,

Je m'oppose toujours à cette proposition de Policy, principalement à
cause que désinscription de ressources ne devrait pas être basé sur le
«jugement» de «meilleure utilisation», idéalement, il ne devrait
jamais y avoir de désenregistrement, à moins qu'une société cesse
d'exister et personne ne reprenne leurs opérations, tout autre raisons
ouvre la porte à des actions en justice.

Si un LIR n'est pas conforme aux policies, ils ne peuvent pas demander
plus de ressources, vous pouvez ajouter des choses comme enlever les
droits de vote et ainsi de suite, mais je crois que ne pas pouvoir
demander plus de ressources Internet a AFRINIC est déjà une raison
suffisante pour corriger tout problème présent.

Cette proposition de policy et l’Anti-shutdown proposent seulement la
désinscription en tant que solution aux problèmes réels.

Nous devons trouver d'autres solutions moins extrêmes et moins radicales.

Les commentaires juridiques sont très inquiétants, ils indiquent
clairement que AFRINIC ltd peut être poursuivi en justice pour
compensation, ces frais juridiques et éventuelles compensations
viendront de nous les membres, alors considérez bien si vous êtes prêt
à voir vos frais augmentés pour payer quelqu'un d'autre qui a u ses
ressources désinscrites au suite d’une review:

“AFRINIC will have to protect itself and act only on reliable, cogent
and admissible evidence before finally revoking allocation of
resources which the investigated member claims has been prejudicial to
it and consequently claims for compensation. This possibility should
always be envisaged. The increasing value of IPv4 resources point in
that way.”

 “Section 13.5 of the proposal states: “the outcome of the arbitration
process is unequivocal”. This is in contradiction of, Articles 1027 to
1027-9 of the Code de Procedure Civile of Mauritius which provides
that a party to an arbitration may seek the “annulation “of an award
by seizing the Supreme Court.”

Le texte de la proposition de policy stipule toujours que “outcome of
the arbitration process is unequivocal", j'ai mentionné dans le passé
que les actions juridiques seront toujours une option pour quiconque
perd des ressources à cause de cette Policy, les commentaires du
personnel sont en accord avec mes commentaires et AFRINIC limited et
ses membres soutiendrons les coûts juridique si on en arrive à cette
étape.

Hi,

I still oppose this policy proposal, mainly based on that
de-registration of resources should not be based on “judgment” of
“better use”, ideally there should never be de-registrations, unless a
company ceases to exist and no one takes over the business, anything
else opens the door for legal actions.

If an LIR is not policy compliant, they do not qualify for more
resources, you could add things like no voting rights and so on, but I
believe that not being able to request additional Internet resources
from AFRININC is already reason enough to rectify any issues one might
have.

This policy and the Anti-shutdown only propose de-registration as a
solution to real problems.
We need to find other solutions that are less extreme and radical.

The legal comments are quite worrying, it clearly states that AFRINIC
ltd can get sued for compensation, these legal costs and eventual
compensations will come from us the members, so do consider if you are
willing to see your fees raised in order to pay someone else who lost
resources in a review:

The policy proposal text still states “outcome of the arbitration
process is unequivocal”, I mentioned in the past that Legal actions
will always be an option for whomever loses resources through this
policy, Staff comments are actually in agreement with those comments
of mine and AFRINIC limited and its membership will have to bear the
legal costs if it ever reaches that stage.
