I would agree that TLD infrastructure should not be considered critical for the purposes of address allocation. When it comes to the DNS, there is really only one set of addresses that truly rate 'critical' because of the challenges in changing them: the 13 root server addresses. 

I suspect the real issue is how address allocation policy can be applied to applications of anycast routing (of which name server infrastructure for TLDs is one).
