[IANA Oversight] IANA IPR agreements

This is an update on the IANA IPR agreements.

As part of the IANA stewardship transition, the plan submitted by the ICG calls for the IANA intellectual property (IPR) to be moved to an entity independent of the current IANA functions operator, and the IETF Trust indicated that it would be willing serve in this role.

Drafts of the necessary agreements were posted for review on 12 August 2016, at <https://www.ianacg.org/call-for-public-comment-on-iana-ipr-agreements/>.rackets to show that 

After the review, a few more small changes were made to the drafts.  Most of the changes consist of filling in dates, names, addresses, and definitions that were previously left blank or marked in square brackets.

The largest change is the addition of a clause describing the effective date.  This is the current draft text:

This Agreement will become effective on the date (“Effective Date”) that the IANA functions contract between NTIA and ICANN ends or is terminated, provided that date occurs before February 1, 2017.  If such ending or termination has not occurred by February 1, 2017, this Agreement shall automatically terminate without further action of the Parties.  Except as provided in the preceding sentence, no Party shall have the right to revoke or terminate this Agreement prior to the Effective Date.

Assuming that all parties are able to agree on the text, we anticipate signing the agreements on or before 30 September 2016, with the agreements taking effect at the time that the NTIA IANA contract terminates.  If the NTIA IANA contract is renewed beyond 1 October 2016, then we will have until the end of January 2017 to figure out what to do about it.

I attach the latest drafts of all the agreements.  The Community Agreement is the only one that the RIRs will sign.
