Dear Mr. Wollner,
We refer to your email dated 14 September 2022. Kindly find our reply as follows:
(i) In regard to your claim concerning payments purportedly made by AFRINIC for "multiple members' flight tickets in the past few weeks, as well as huge sponsorship expenses that far exceed normal operating budget", do substantiate your claim with clear and precise particulars before we may, subject to part (iii) below, be in a position to consider a response; failing which we shall assume that you are embarking upon a fishing expedition for confidential information.
(ii) We reject your gratuitous, unfounded, and unwarranted statement regarding AFRINIC’s legal representations in Court. We understand similar statements have been made in Court against AFRINIC and therefore, we shall refrain from commenting further on this, having regard to the sub-judice rule.
(iii) As regards the financial information sought from the Finance Department, we refer to our reply dated 29 July 2022, addressed to you, concerning our approved process of financial scrutiny and our predicament in connection thereof.
Further, since you are the sole director of Africa on Cloud (Pty) ltd and who is the source of an application for an injunction in the case Africa on Cloud (Pty) Ltd vs Afrinic case bearing reference SC/COM/WRT/000418/2022 which has resulted in AFRINIC not having a quorate board to deliver on its role and functions as Regional Internet Registry for the African service region, we, therefore, condemn your attitude and bad faith in sending emails containing allegations as well as insinuations to both AFRINIC's Members-Discuss and Community-Discuss mailing lists in order to incite and/or provoke reactions from others, and that despite you having full knowledge of AFRINIC's current situation.
We remind you that since you opted to pull AFRINIC to Court, we urge you to respect the court process and thus avoid provoking discussions on matters which are live before the Court.
