<span class="txtTitre20_actu"><b>La PARL des noms marocains</b></span><br><br>
<b>Les
autorités marocaines en charge du .MA ont adopté une Procédure
Alternative de Résolution des Litiges (PARL), qui sera administré par
le Centre d'Arbitrage et de Médiation de l'OMPI. Détails de cette PARL
spécifique au .MA.</b>
<br>
<br>La Procédure Alternative de Résolution des Litiges (PARL) relatifs
aux noms de domaine marocains est encadrée par la charte de nommage du
.MA et plus spécifiquement ses articles 21 et suivants [1] ainsi que
par le règlement de l'OMPI sur la PARL marocaine [2].
<br>
<br>Afin de ne pas semer la confusion entre les différentes PARL
existantes, il peut être utile de les distinguer en y accolant le ccTLD
correspondant (PARL.ma pour le Maroc ou PARL.fr pour la France).
<br>
<br>La PARL.ma reprend la trame essentielle et commune à la plupart des procédures extrajudiciaires (ou DRP pour <i>Dispute Resolution Policy</i>)
relatives aux litiges pour des ccTLDs. Toutefois, quelques spécificités
méritent d'être soulignées concernant le champ d'application du
règlement (I) et certains éléments processuels (II).
<br>
<br><font color="#02a8c2" face="verdana"><b>I – Le champ d'application du règlement PARL.ma</b></font>
<br>
<br>Le champ d'application du règlement est fixé par les dispositions
combinées de l'article 1er, qui définit la PARL.ma, et de l'article 2
qui précise le cadre des litiges concernés.
<br>
<br>L'article 1er définit la PARL.ma comme suit : "<i>ensemble de
procédures adoptées et mises en oeuvre par l'Organisation Mondiale de
la Propriété Intellectuelle (OMPI) pour le règlement des différends
relatifs aux noms de domaine Internet ".ma" se rapportant aux marques
de fabrique, de commerce ou de service protégés au Maroc</i>".
<br>
<br>Quant à l'article 2, il fait peser sur le demandeur la preuve (i)
d'un risque de confusion avec une marque sur laquelle il détient des
droits, (ii) l'absence de droit ou intérêt l'intérêt légitime du
défendeur sur le nom de domaine et (iii) la mauvaise foi de ce dernier
à l'occasion de l'enregistrement ou de l'utilisation du nom de domaine
litigieux.
<br>
<br><b>Une PARL restreinte aux seules marques protégées au Maroc</b>
<br>
<br>Par ailleurs, et c'est une précision importante, la PARL.ma est
restreinte, quant à l'objet protégé, aux seules marques de fabrique, de
commerce ou de service sur laquelle le requérant a des droits protégés
au Maroc. <br>
<br>En outre, l'article 23 de la charte de nommage précise que "<i>les
litiges qui ne portent pas sur un nom de domaine ".ma" ayant trait aux
marques de fabrique, de commerce ou de service protégées au Maroc sont
portés devant le tribunal compétent</i>".
<br>
<br>L'application de la PARL.ma est donc soumise à deux conditions :
<br><ul><li>le nom de domaine disputé est enregistré sous le .ma
<br></li><li>le demandeur est propriétaire d'une marque de fabrique, de commerce ou de service protégée au Maroc</li></ul>
En l'absence de ces deux conditions, la PARL.ma sera inapplicable et
seules les voies de la transaction et de la procédure judiciaire
resteront ouvertes à celui qui s'estime lésé.

<br><font color="#02a8c2" face="verdana"><b>II – Eléments processuels propres à la PARL.ma</b></font>
<br>
<br>Deux éléments appelent l'attention :
<br><ul><li>d'une part, la personne de l'expert
<br></li><li>d'autre part, la langue de la procédure</li></ul> <b>L'expert</b>
<br>
<br>La PARL.ma se déroule devant un expert unique, et non devant un
panel d'experts. Cet expert est choisi par le Centre d'Arbitrage et de
Médiation de l'OMPI pour figurer sur la liste des experts [3] chargés
de résoudre les litiges relatifs aux noms de domaine marocains, la
liste étant réservée aux "<i>juristes qualifiés en droit marocain</i>" (art. 4(b) du règlement).
<br>
<br><b>La langue de la procédure</b>
<br>
<br>L'article 8 du règlement pose le principe selon lequel la langue de
la procédure est le français. Toutefois, et ce n'est pas une surprise,
l'expert garde la faculté "<i>d'en décider exceptionnellement autrement
sur demande de l'une des parties ou des deux, ou à sa discrétion, au vu
des éléments de la procédure</i>".

operated the previous version of the registration system. This change will mean
savings of tens of millions of Crowns a year. For domain holders, the change
