No Mr. Mike Silber, you are obviously conflicted, but you are not man
enough to admit it to yourself. As a man, DCA thinks that you have no
integrity. If you had any, you would have honourably and respectfully
recused yourself from further participating in the ICANN new gTLD Program
Committee. The fact is that you are a Board Member of the ZADNA, an
organization that has openly endorsed UniForum ZA Central Registry as an
applicant for the .Africa gTLD. As a Board Member of ZADNA, you are also a
party to that endorsement of UniForum, and you still expect to be believed
that you are a man of integrity who is not conflicted over .Africa. Please
tell that to the marines! Why would an ICANN Board Member such as
yourself be linked in any way to the endorsement received by an applicant
for a name string participating in the ICANN new gTLD program? The
relationship between you and the ZADNA is so glaringly patent, yet you try
to dismiss it as an arms-length relationship. How could active Board
membership be described by anyone as an arms-length relationship?
Everyone knows what your voting record is on the ICANN new gTLD Program.
You had abstained from voting, so the record actually shows that you did
not approve it in June 2011 at Singapore because you thought it was not
ready. According to information available from

*the ICANN Board decision to approve the program on 20th June 2012 was also
criticised by abstaining ICANN director Mike Silber, who said it was not
ready yet and subject to "ego-drive deadlines".* So what are you doing
in the new gTLD Program Committee of ICANN against the backdrop that you
did not approve the program in the first place? Whose interest are you now
serving? The interest of an ICANN new gTLD program that you did not approve
of, or the interest of a community that you claim to have your trust?
You are a lawyer by training, so nobody can tell you anything about legal
liability, but you must know that you will be actually exposing yourself to
personal legal liability if you fail to recuse yourself from further
Board-level or Committee-level responsibilities regarding the new gTLD
Program; and if your continuing presence on the new gTLD Program Committee
results in any negative impacts on DCA's application. Your past media
statements have revealed your decision-making preferences on this issue.
For example, TechCentral.co.za <http://techcentral.co.za/> quoted you as
saying that: “It is a pity that some *individuals are allowing personal
issues to get in* the way of a project that could benefit a larger

Evidently, you have always had, and espoused, a Pro-Community opinion on
this matter of .Africa, so your preference is widely known, and this will
expose you to personal legal liability. Now, your statement that *"I also
think that the trust of this community is far more important"* shows that
you intend to keep the trust of the community so that you can use your
ICANN Board position and membership in the ICANN new gTLD Program
Committee to unfairly assist UniForum as an applicant working closely with
the community, even though you are already deeply conflicted over the issue
of .Africa.
Therefore, if you are not interested in *"some small financial victory in a
court of law"* against DCA, you should equally know that DCA Trust would be
very much interested in winning a huge financial victory over you, and take
great pleasure in hanging you out to dry like biltong! And when that
happens, there will be no community to come to your aid when you suffer
public shame and opprobrium as a deeply conflicted man who lacked
integrity! We believe that you have *only two options to consider at this
stage: step down immediately from the ICANN new gTLD Program Committee and
actually demostrate that you are truly a man of integrity; or consult
immediately with your lawyers and prepare yourself for an upcoming legal
battle.
