The new Expressions of Interest period opens on 31 July, 2009 and closes on 15 September, 2009 at 23:59 UTC. The evaluation areas needed are: Applicant Evaluation Teams (Technical and Financial Evaluation) Geographic Name Evaluation String Similarity Examiners Community Priority Evaluation Panel -- formerly the Comparative Evaluation Panel Below are the links for the extension of the posted Expression of Interest which contain the criteria for each panel: http://www.icann.org/en/announcements/announcement-2-02apr09-en.htm ICANN is pleased to report that during the initial open search period (25 February, 2009 to 11 June, 2009) it received expressions of interest from nine, well-qualified candidates interested in serving as independent evaluators. ICANN would like to acknowledge and thank those respondents listed below. ICANN continues to engage in further discussions with the current candidates and will shortly hold an "EOI responders conference" limited to the firms that responded by the original due date of June 11, 2009. The outcome of this conference will be shared with the public and used to better inform potential new candidates. The existing candidates will also be able to update their proposals based on this interaction. The decision to reopen the search period has been made to accommodate the internal requirement to build a robust and scalable operations process with primary and secondary service providers as well as to eliminate the appearance of conflict in the evaluation process. The Independent Evaluators are expected to be identified by ICANN in Q4, 2009. All members of the ICANN community are now invited to review that document (http://www.icann.org/en/topics/geographic-regions/initial-report-geo-regions-review-wg-31jul09-en.pdf [PDF, 100K]) and share comments and observations with the community through 4 September 2009. Background: Geographic diversity is a fundamental component of the ICANN organization. The ICANN Bylaws (Article VI Section 5) currently define five geographic regions as Africa, North America, Latin America/Caribbean, Asia/Australia/Pacific and Europe. The ICANN Geographic Regions were originally created to ensure regional diversity in the composition of the ICANN Board and were subsequently expanded in various ways to apply to the Generic Names Supporting Organization (GNSO), At-Large Advisory Committee (ALAC) and the Country Code Names Supporting Organization (ccNSO). An ICANN Board resolution in 2000 directed Staff to assign countries to geographic regions on the basis of the United Nations Statistics Division's current classifications, and introduced the concept of "citizenship" in relation to the definition of ICANN Geographic Regions. Over time, the ccNSO has developed concerns about the implementation of the ICANN Geographic Regions and related representational issues. The ccNSO Council approved a resolution in 2007 recommending that the ICANN Board appoint a community-wide working group to further study and review the issues related to the definition of the ICANN Geographic Regions, to consult with all stakeholders and submit proposals to the Board to resolve the issues relating to the current definition of the ICANN Geographic Regions. The Board determined at its meeting in Los Angeles on 2 November 2007, that because any potential change to ICANN Geographic Regions could have widespread effect in ICANN, the views of other Supporting Organizations and Advisory Committees should be sought by the Board. The Board asked the ICANN community, including the GNSO, ccNSO, the Address Supporting Organization (ASO), GAC, and ALAC, to provide the ICANN Staff with input on the ccNSO Council's resolution relating to ICANN's Geographic Regions - including the proposal to appoint a community-wide working group to review the structure of ICANN's present Geographic Regions and related issues, as suggested by the ccNSO. The community supported the concept of the working group and the Board authorized its formation at its December 2008 Meeting (see - http://www.icann.org/en/minutes/resolutions-07nov08.htm#_Toc87682556). Explanation: The Board approved the Charter of the working group at its public meeting in Sydney Australia (see - http://www.icann.org/en/minutes/resolutions-26jun09.htm#1.2). Copies of the Charter, in all six UN languages, are posted in the Public Comment Forum Box (see - http://www.icann.org/en/public-comment/public-comment-200909.html#geo-regions-review). The Charter authorized by the Board outlines a three-part process in which the working group first prepares an Initial Report outlining the current applications of ICANN's geographic regions in various ICANN structures and processes and confirming the issues to be addressed by the working group during its deliberations. That Initial Report is the document being posted today. According to the Charter, the Initial Report will be followed by an "Intermediate Report", currently scheduled to be drafted and prepared by the October 2009 Seoul ICANN meeting. A third "Final Report" that will include the working group's recommendations (if any) is currently scheduled to be published early next year. That summary/analysis will be shared with the community and the Working Group. The Working Group will review the community input on the Initial Report to guide its deliberations and future work on the Intermediate Report and Final Report documents. Deadline and How to Submit Comments: The Staff is opening a 35-day public consultation forum, from 31 July 2009 through 4 September 2009, and invites community comments on this topic. New transitional ICANN Board appointments will fill three of the new Council seats. This month the ICANN Board is accepting Statements of Interest from members of the non commercial community who would like to volunteer for these three new positions and potentially serve as full GNSO Councilors for the next two years. As outlined in the attached flyer [PDF, 226K | DOC, 148K] http://www.icann.org/en/committees/improvements/soi-notification-board-ncsg-appointments-04aug09-en.pdf this is a unique opportunity for leaders in the non commercial community to step forward and serve the ICANN community at a pivotal moment in the Internet's development. Background and Explanation: At its 30 July meeting the ICANN Board approved a transitional charter for a new Non Commercial Stakeholders Group (NCSG) (see - http://gnso.icann.org/en/improvements/ncsg-proposed-charter-30jul09-en.pdf). The charter sets out a transitional approach (Section 8 - Appendix) for selecting the NCSG's GNSO Council representatives. Under this transitional approach, the current Non-Commercial Users Constituency (NCUC) will elect 3 Council seats (in total). The remaining 3 seats will be temporary Board appointments with the expectation that additional non-commercial Constituencies will be formed/approved and participate in filling future NCSG Council seats. The transition period will be two years. Of the four new Stakeholder Group Charters approved by the Board last week, this temporary seat selection by the Board is unique to the NCSG. It reflects a fundamental view that the current non-commercial community participation in the GNSO is not yet sufficiently diverse or robust to select all six of the NCSG's allocated Council seats (as was originally intended by the Board's GNSO Improvements initiative). It is important to note that this condition is temporary. The Board expects that the new Board-appointees will work hard in the coming months with the ICANN Staff and the community to forge new relationships and structures that will achieve the Board's goal of a robust and diverse non-commercial community within the GNSO framework. At the direction of the Board's Structural Improvements Committee (SIC), the ICANN Staff has prepared a formal GNSO Council NCSG Position Notification Form [PDF, 60K | DOC, 71K] and a formal Statement of Interest Form application [PDF, 30K | DOC, 54K] for interested persons to review. The GNSO Council NCSG Position Notification Form explains the duties of the new positions. The Statement of Interest Form asks interested persons for some personal information and gives volunteers the opportunity to explain their interest in the positions and their qualifications for the Council member duties. The Board and ICANN Staff will keep all submissions in strict confidence and no personal contact information will be shared. The Process From Here: The Board hopes that a number of candidates will express their interest in volunteering for these new positions over the course of this month. The Structural Improvements Committee of the Board will evaluate all statements of interest and will make recommendations for finalists to the full Board for consideration at the Board's scheduled 30 September special meeting. Selected candidates will be notified as soon as possible to give them an opportunity to travel to and participate in the first meeting of the restructured GNSO Council in Seoul, South Korea on 28 October 2009. Deadline and How to Submit Statements of Interest: Statements of Interest will be accepted through Noon PDT on Monday 31 August 2009 at the email address - ncsg-seats@icann.org The promotional flyer announcing this opportunity can be found here: [PDF, 226K | DOC, 148K] http://www.icann.org/en/committees/improvements/gnso-councilor-recruitment-advertisement-05aug09-en.pdf The formal Statement of Interest Form can be found here: [PDF, 30K | DOC, 54K] http://www.icann.org/en/committees/improvements/soi-form-ncsg-council-positions-2009-2011-en.pdf The formal Position Notification Form can be found here: [PDF, 60K | DOC, 71K] http://www.icann.org/en/committees/improvements/soi-notification-board-ncsg-appointments-04aug09-en.pdf Staff Responsible: Robert Hoggarth (please send specific questions or queries to policy-staff@icann.org) Glen de Saint G?ry GNSO Secretariat gnso.secretariat@gnso.icann.org http://gnso.icann.org From Glen at icann.org Thu Aug 6 10:00:23 2009 From: Glen at icann.org (=?iso-8859-1?Q?Glen_de_Saint_G=E9ry?=) Date: Thu Aug 6 10:00:36 2009 Subject: [AfrICANN-discuss] Lead Networks Files for Arbitration Message-ID: <05B243F724B2284986522B6ACD0504D7AE0DAA5293@EXVPMBX100-1.exc.icann.org> Lead Networks Files for Arbitration http://www.icann.org/en/announcements/announcement-2-05aug09-en.htm 5 August 2009 On Friday, 24 July 2009, Lead Networks Domains Pvt. Ltd. ("Lead Networks") began the process of commencing an arbitration proceeding with the American Arbitration Association ("AAA") challenging ICANN's decision to allow the RAA to expire without renewal because of Lead Networks' failure to comply with the requirements of its RAA http://www.icann.org/correspondence/burnette-to-malik-14jul09-en.pdf [PDF, 74K]. In its filing to initiate arbitration, Lead Networks requested that ICANN and the arbitration panel stay the non-renewal until an arbitration decision is rendered. Although Lead Networks allowed the RAA to expire before seeking to arbitrate, ICANN has determined that a temporary stay is warranted in this case to protect affected registrants and users. Lead Networks will be reinstated as a registrar effective Tuesday, 04 August 2009. Guidance is provided below for registrants who may be affected by this arbitration action. Frequently Asked Questions Q. How are registrants affected by Lead Networks' arbitration filing? A. Your domain names will remain with Lead Networks until the arbitration panel renders its decision or until you choose to transfer your domain name. In other words, during the arbitration, Lead Networks will operate as an ICANN-accredited registrar pursuant to the RAA and shall be required to comply with all contract provisions, the Uniform Domain Name Dispute Resolution Policy ( "UDRP"), and the transfer policy. Q. What happens if I have a pending UDRP administrative proceeding involving a domain name sponsored by Lead Networks? A. Continue with the proceedings, as you do not need to do anything additional right now. Lead Networks will continue to be obligated to perform under the RAA and, thus, will be required to enforce the decision once panel provides its ruling. Q. What happens if I won a UDRP administrative proceeding involving a domain name sponsored by Lead Networks? A. In accordance with the RAA, Lead Networks is required to enforce the arbitration panel's decision unless the registrant provides evidence of a lawsuit against the complainant in a court of mutual jurisdiction within 10 business days of the issuance of the UDRP decision. If Lead Networks has not enforced the decision, please immediately submit a report pursuant to the UDRP Intake Report System at http://www.internic.net/UDRPIntakeReportSystem.html. Please be sure to complete all fields and follow all prompts. Q. What action is ICANN planning to take? A. During the arbitration process, ICANN intends to aggressively defend its decision not to renew the RAA with Lead Networks. Q. How long will it take to complete the arbitration? A. Arbitration is unpredictable. ICANN hopes and will request that the arbitration panel conclude the arbitration as quickly as possible, but it could be several months before an arbitration decision is rendered. Q. What affect does the arbitration filing have on ICANN's previously announced bulk transfer process? A. ICANN will continue to complete the process pursuant to the De-Accredited Registrar Transition Procedure (posted at http://www.icann.org/en/processes/registrars/de-accredited-registrar-transition-procedure-01oct08.pdf [PDF, 119K]) in order to be prepared to authorize a bulk transfer of the names upon conclusion of the arbitration, if necessary and such a transfer would promote the community interest. Q. I have read everything above, but still have some questions about my domain name. Whom should I contact? A. You should contact Lead Networks first with any issues. If you are still not able to get answers to your questions, please contact ICANN's contractual compliance team at compliance@icann.org. "The Fellowship program is a real testament to the importance ICANN places on global engagement increased participation from the developing and least developed world," said Theresa Swinehart, ICANN's Vice President, Global and Strategic Partnerships. "Reaching out to the global community, we saw a desire to be a part of the key discussions that take place at our meetings, but some countries and Internet users just didn't have the resources to attend. The Fellowship program helps bridge that gap." As a reminder about the process, applications for each meeting are accessed by an independent selection committee, and priority is given to applicants who are current residents of developing and least developed nations interested in participating in ICANN and its supporting organizations, such as the Governmental Advisory Committee, the Country Code Names Supporting Organization, and the Generic Names Supporting Organization. Additionally, all confirmed fellowship participants must comply with the terms and conditions of the program, as outlined at http://www.icann.org/en/fellowships/terms-and-conditions.htm. As stated within these terms and conditions, ICANN is a California non-profit public benefit corporation incorporated in the United States and must therefore comply with all the laws and regulations of California and the United States. Fellows are responsible for obtaining all travel visas once accepted into the program. ICANN will only purchase tickets for Fellows after all necessary documentation has been obtained and Fellows demonstrate that they have obtained all necessary travel visas. Once all of the requirements for travel are met, the Fellowship program arranges airfare and hotel, as well as provides a small stipend to assist with some meeting costs incurred, following successful completion of the Fellowship program. Recipients will be expected to actively participate in and contribute to ICANN processes. As always, registration for ICANN's meetings is free for anyone wanting to attend. The Seoul meeting will be held from 25?30 October 2009. For the Seoul meeting, 35 Fellows have been selected (or deferred from previous meeting) from 29 countries, chosen amongst the 132 applications received from 65 countries. 9 of the Fellows are alumni from at least one of the past seven programmes; 20 Fellows are first-time attendees to any ICANN meeting and 6 have attended past meetings, but are first time Fellows. There is representation from all sectors including civil, government, academia, and from business or user groups. Included in these sectors are representatives of country code supporting groups. You will find the list of participants at http://www.icann.org/en/fellowships/. The 37th ICANN International Public Meeting will be held in Nairobi, Kenya from 7-12 March 2010. Applications will go online 28 September 2009 at http://www.icann.org/fellowships/. "We have seen the fellowship recipients in action since our first meeting in San Juan in June 2007 ? and they have grown in their level of understanding and participation in the ICANN process and community," Swinehart added. ?ICANN is in the middle of major initiatives around new top-level domains, the introduction of internationalized domain names, to name just two, and the Fellowship program has a key role in making sure we get the broadest possible input on these matters." *About ICANN: * ICANN is responsible for the global coordination of the Internet's system of unique identifiers such as domain names (.org, .museum and country codes like .uk) and the addresses used in a variety of Internet protocols that help computers reach each other over the Internet. Careful management of these resources is vital to the Internet's operation, so ICANN's global stakeholders meet regularly to develop policies that ensure the Internet's ongoing security, stability, and interoperability. ICANN is an internationally organized, public benefit non-profit company. There is a need to outreach some ccTLDs with a message that will encourage them joining. That is for those ccTLDs that have a business/management structure that allows such intervention. The benefits of joining ccNSO are obvious, and to the large extent joining would be an indicator of a responsibility to the society that ccTLD serves. That is my (frustrating) opinion. In a statement on its website, the .aeDA claimed that the domain name was registered on January 28, two days after the signing of the IRENA EU statute in Bonn, but that following the registration, Reed put up the domain name for sale on the website Youcanbuythiswebsite.com. Related: UAE domain regulator accused in copyright row Story continues below ? advertisement It also said Reed had failed to provide ?adequate or timely information? to support his registration. Responding to the statement, Reed said: ?The domain was registered through Instra.com in January 2009 by another party through a registrar called ?Instra.com?. ?It clearly then became available and so I registered it through IP Mirror, who are a registrar for .ae domain names. ?I did not at anytime offer the domain for sale.? Reed has said his company will scrap its plans to enter the UAE market unless the domain is transferred back to his company. ?One has to wonder how safe any .ae domain name is if they simply take them whenever they feel like it,? he said. ?Furthermore, the International Renewable Energy Association (IRENA) in Germany have told me that they do not want the domain as they use irena.org ." IRENA chose Abu Dhabi to host its first international headquarters in June this year. In addition to your views on these questions, the Working Group is particularly interested in receiving supporting data and information related to the questions outlined below. Any information to help quantify the problem or information on specific situations that you are aware of that might be addressed as part of these questions, would be appreciated. Background To what extent should registrants be able to reclaim their domain names after they expire? At issue is whether the current policies on the renewal, transfer and deletion of expired domain names are adequate. To this end, the GNSO Council initiated a Policy Development Process (PDP) on 24 June 2009 and chartered a Working Group to answer the following questions: Whether adequate opportunity exists for registrants to redeem their expired domain names; Whether expiration-related provisions in typical registration agreements are clear and conspicuous enough; Whether adequate notice exists to alert registrants of upcoming expirations; Whether additional measures need to be implemented to indicate that once a domain name enters the Auto-Renew Grace Period, it has expired (e.g., hold status, a notice on the site with a link to information on how to renew, or other options to be determined); Whether to allow the transfer of a domain name during the Redemption Grace Period (RGP). The current membership list is available at http://ccnso.icann.org/about/members-sort-region.htm Since the ICANN bylaw changes that have seen the other region ccTLDs respond by joining, I would like to find out if ccTLDs in Africa still have barriers that prevent them from making an application to join the ccNSO. Communications Area Manager ??????????????????????????????????????????????????????????????????????????????????????????????????????? press@afrinic.net ??????????????????????????????????????????????????????????????? ????? Root Server Anycast Copy Deployed at Tanzania Internet Exchange AfriNIClaunched its Root Server Anycast Copy Program in Cairo, Egypt, October 2008, with the objective of increasing the number of instances of Anycast copies of root servers in the African region in order to improve the local Internet infrastructure scalability and reliability. Three fundamental reasons have encouraged the distribution of the root servers at many locations around the world. 1. Better load management on root servers; 2. Resilience to DDoS (Distributed Denial of Service) attacks; and, 3. Lower RTT (Round Trip {delay} Time) between clients and servers. When a region or a country loses its international connectivity, access to root servers is preserved by virtue of the local node. This enables the local traffic developed through IXPs and transit points to proceed. In another term, this will allow the local Internet to continue to be able to resolve names and access to local services. Today, we are pleased to inform you that the first deployment under our program was completed on Wednesday, August 19, 2009 in Dar es Salaam at the Tanzania Internet Exchange (TIX), where a copy of the K root server operated by RIPE NCC is installed and running. ?This is another exciting step we are taking to improve Internet service in Tanzania. We want to thank AfriNIC and RIPE NCC for their support in this project? stated Frank Habicht, TIX Manager. ? ?This deployment is very critical as it helps to address the issue of ?Access? in Tanzania and it is an important milestone towards our objective to contribute more to the Internet infrastructure development in our region. We are looking forward to more deployments of this kind in the coming months? stated Adiel Akplogan, CEO, AfriNIC. We congratulate TIX for its participation in the AfriNIC Root Server Anycast Copy Program and wish them a great success! Furthermore, we would like to extend special thanks to RIPE NCCwho actually carried out the deployment, Tanzania Internet Service Providers Association (TISPA)for local support, SimbaNETand Africa Online for the transit provided, and the AfriNIC Project Team.? The comment period is an experiment in online collaboration and uses Jive software to allow simple interaction and discussion between community members on particular topics. The hope is to increase the speed and effectiveness of consensus-building while allowing for broader, simpler participation in ICANN's processes. You will need to register with the site to post comments, responses and blog posts as well as rate other's comments and vote in polls. But we have included a traditional email-only input method as well. The AC/SO Summary is a one-page summary of the joint meeting of ICANN's Supporting Organizations and Advisory Committees in Sydney. That meeting drew out six main issues as well as seven suggested solutions to fix those issues. The online comment space will therefore restrict itself to discussion of those issues and their related solutions. There is also a discussion space for people to comment on the software itself. The top two issues identified by the community in Sydney were frustration and exhaustion at the huge volume of work, and the lack of visibility of the impact of volunteer input on decision-making. The top three suggested solutions were: prioritization of the workload; better scoping of issues at the start of policy processes; and improving accessibility to issues by providing summaries. Now we need you as the community to flesh out these broad points into specific ideas and suggestions. The discussion space will be shut down after 30 days as the experiment closes and a report will then be written covering what happened as well as the feasibility of using Jive or similar software for future community discussions. So if you want to make your voice heard not only about how ICANN can improve but the ways in which those improvement discussions are held, then please login on today and start interacting. The comment period will end 24 September 2009. You can log-on to the collaborative space at: https://jive.dev.icann.org/community/acso. If you would prefer to email in your comments, please send them to acso-discussion@icann.org. Remote participation for the event was made available via Adobe Connect and an audio conference bridge. The regional event model was introduced in 2006 as a means to inform and educate gTLD registries and ICANN-accredited registrars about ICANN activities and processes that may impact their operations. These events also broaden participation in the ICANN multi-stakeholder governance model for registry and registrar staff members who do not generally attend ICANN?s annual public meetings. ICANN subject matter experts facilitated discussions on issues such as gTLD registry continuity, contractual compliance, new gTLDs, GNSO policy activities, security initiatives, the 2009 Registrar Accreditation Agreement, and the terminated registrar transition process. Such discussions enhance knowledge and foster better cooperation between ICANN and its contracted stakeholders. The Toronto event also featured a session on registry/registrar areas of interest that was facilitated by David Maher, Chair, Registry Constituency, and Mason Cole, Chair, Registrar Constituency. The chairs co-led a discussion about how the two groups might work better together on joint areas of interest such as electing leaders for the GNSO Council and engaging in discussions when new registry service requests, submitted via the Registry Services Evaluation Process (RSEP), have the potential to impact registrars. In the interest of transparency, the presentations are being made public. An HTML attachment was scrubbed...
